- The International Classification for the Purpose of registering Trade or Service Marks under the Nice Agreement is followed in Kuwait.
- A separate application should be filed with respect to each class of goods and services.
- Alcoholic drinks in classes 32 and pork meat in class 29 are not allowed to be registered in Kuwait.
- Class No. 33 has been completely dropped and the international class 34 has been reinstated for tobacco products.
- Trademark registration is valid for a period of 10 years from date of filing.
- A trademark registration is renewable for a period of 10 years each. A SIX-month grace period is provided for late renewal of a trademark subject to the payment of a lateness fine.
- The assignment of a trademark can be recorded once the trademark is registered. Changes in the name or address of a registrant, amendment of a trademark and limitation of goods covered by a registration can be recorded as well.
- It is not necessary to submit all relevant documents at the time of filing. The documents can be filed at a later stage.
Filing Requirements:
- A Power of Attorney legalized up to the Consulate of Kuwait. General Power will suffice for continuous applications.
- 12 prints (for each class).
- A legalized copy of the home registration certificate of the trademark or any other legalized copy of foreign registration certificate of the trademark can be used along with a certificate proving that the trademark is not registered in the home country.
Renewal Requirements:
- A Legalized Power of Attorney up to the Kuwaiti Consulate.
- The original Kuwaiti registration certificate of the trademark for endorsement purposes.
Assignment Requirements:
- A Legalized Power of Attorney upto the Kuwaiti Consulate
- A Deed of Assignment that has been signed by both parties and legalized upto the Kuwaiti Consulate.
- The original registration certificate for endorsement.
Change of Name/Address Requirements:
- A Legalized Power of Attorney up to the Kuwaiti Consulate.
- An official legalized certificate proving the change of name and/or address up to the Kuwaiti consulate.
- The original Kuwaiti certificate of registration of the trademark for endorsement purposes.
Merger Requirements:
- A Power of Attorney duly legalized up to the Kuwaiti Consulate.
- A merger document legalized up to the Kuwaiti Consulate.
- PDF copy of the Kuwaiti registration certificate of the trademark.
